Chris Scott, the owner of the tiny Whistlestop cafe in Mirror, Ab., has launched legal action against Alberta Health Services and Chief Medical Officer of Health Dr. Deena Hinshaw for shutting down his business during the COVID-19 pandemic..Scott and his cafe, 50 km east of Red Deer, were the lightning rod for protest actions against the restrictions imposed by the Alberta government during the pandemic..AHS ordered him closed and when he refused he was ticketed by the RCMP. Later in May, officers – in a Prohibition-style raid – took all his booze..Eventually, an early morning raid by the authorities led to the cafe being padlocked.. Whistlestop Cafe owner launches lawsuit against AHS & HinshawScott being arrested by RCMP .Undeterred, Scott continued cooking pancakes, making burgers and serving coffee to his customers in the parking lot outside his shuttered restaurant..A weekend protest that drew more than 1,000 people was the final straw for the health authorities and RCMP arrested him, throwing him in jail for the weekend..“It’s official. I’ve filed a claim against the Crown, the CMOH, and AHS in response to their blatant violations of my, and YOUR, charter rights and freedoms,” Scott posted on social media Monday, after the documents were filed in Calgary Court of Queen’s Bench..“How can the government hide behind legislation that explicitly states that the Alberta Bill of Rights must be upheld in application of the act and then instead trample all over it without justification?.“I would encourage you to go back through my posts from January through May and listen carefully to what I’ve been saying. I’ve made mistakes, yes. I’m human and not perfect. But I know what’s right and I’ll fight for it. And I’ll fight for you, too. Your opinion of me and of my actions won’t change that.”.Scott said earlier in the day he will now seek elected office by running for the Wildrose Independence Party in the upcoming 2023 election..Scott has owned the cafe since July 2019, but it has been a fixture in town since 1967..“As this is now before the courts, AHS has no comment at this time,” said AHS in a statement to the Western Standard..Dave Naylor is the News Editor of the Western Standard.,dnaylor@westernstandardonline.com,.Twitter.com/nobby7694
